Supreme Court Halts Suspension of Kuldeep Sengar’s Life Sentence in Unnao Rape Case

New Delhi: The Supreme Court on Monday stayed a Delhi High Court order that had suspended the life sentence awarded to expelled Bharatiya Janata Party (BJP) leader Kuldeep Singh Sengar in the 2017 Unnao rape case, directing that he should not be released from jail. The apex court passed the order while hearing a plea filed by the Central Bureau of Investigation (CBI), which challenged the High Court’s decision to suspend the sentence.

Making it clear that Sengar would continue to remain behind bars, the Supreme Court said that substantial questions of law had arisen in the matter, particularly concerning the interpretation of the term “public servant” under the Protection of Children from Sexual Offences (POCSO) Act. The court observed that the legal issue raised had wider implications and required careful examination.

The bench noted that an interpretation of the law that excludes elected representatives from the definition of “public servant” under the POCSO Act could lead to serious consequences. Such an interpretation, the court indicated, would have far-reaching effects beyond the present case, underscoring the need for judicial scrutiny at the highest level.

While staying the High Court’s order, the Supreme Court also addressed remarks and commentary aimed at the judiciary in connection with the case. The apex court strongly condemned any attempts to cast aspersions on High Court judges, asserting that the integrity of the judiciary is unimpeachable. The court emphasized that judges must not be subjected to unwarranted criticism or allegations, especially in the context of judicial decisions delivered in the discharge of their duties.

As a result of the Supreme Court’s intervention, Sengar will not be released from custody. Apart from the life sentence awarded in the Unnao rape case, he is also serving a separate 10-year prison term in another case related to the custodial death of the rape victim’s father. This additional sentence independently requires him to remain in jail.

The case has been closely watched due to the serious nature of the charges and the legal questions involved. The Supreme Court’s order ensures that the status quo is maintained while the legal issues raised by the CBI are examined in detail. By staying the suspension of the life sentence, the apex court has effectively put on hold the High Court’s relief to Sengar until further orders.

The court’s emphasis on the interpretation of statutory provisions under the POCSO Act highlights the importance of clarity in criminal law, especially in cases involving sexual offences. The observation regarding the definition of “public servant” indicates that the court is mindful of the broader legal framework and its implications for accountability.

The Supreme Court’s remarks on the judiciary’s integrity also serve as a strong reminder of the need to respect judicial institutions. By firmly rejecting any attempts to malign judges, the court reinforced the principle that judicial decisions must be debated through legal processes rather than through personal attacks.

The matter will now be taken up for further consideration, with the Supreme Court set to examine the questions of law raised in the CBI’s plea. Until then, Kuldeep Singh Sengar will continue to remain in prison, with the suspension of his life sentence remaining stayed by the apex court.
